5.15 Car parking

Enforcement

If abuse of the parking provisions for disabled people is to be controlled, enforcement of regulations is essential. The ability to enforce at law is dependent upon the location of the parking space and whether or not it has been designated by a parking place order as reserved for Blue Badge holders. The power to enforce is as follows:

On Street - Designated by Parking Place Order. Police can issue fixed penalty notices. Both the police and local authorities have powers to prosecute. A maximum fine of £400 can be imposed.
On Street - Advisory space. Not enforceable by law
Off Street - Local Authority car park, designated by Parking Place Order. Enforcement is a matter for the Local Authority, not the police. Local authorities have powers to prosecute. A maximum fine of £400 can be imposed.
Off Street - Privately operated car park. Not enforceable by law. Individual operators should take whatever steps they consider necessary to see that spaces are not misused.

As an aid to deterring abuse of spaces designated for Blue Badge holders, commercially produced space reservation devices, incorporating visual and audible warnings, are available. In tests, these warning devices have reduced abuse by up to 90%.
